NIKA is a software instrument. These terms define the conditions under which it is licensed, used, and supported. Purchasing constitutes agreement.
Nothing in these terms excludes, restricts, or modifies any right or guarantee you hold under the Australian Consumer Law or any other non-excludable applicable law.
NIKA Synthesiser ("the Software") is sold by nikki.vst, a sole trader operating in Victoria, Australia. ABN: 89 644 100 502. Contact: contact@nikkivst.com.
All transactions are processed by Paddle.com, who act as Merchant of Record. Your payment contract is with Paddle. Paddle collect, process, and are responsible for all payment information, applicable tax, and remittance. Their terms govern that relationship: paddle.com/legal/buyers.
Prices are in USD. Local currency conversion and taxes (GST, VAT, sales tax) are calculated and collected by Paddle at checkout.
Upon confirmed payment, a download link is issued. The Software is delivered digitally. No physical media is shipped.
You receive a personal, non-exclusive, non-transferable licence to install and use the Software on up to two computers you own or personally control. You may not:
This licence covers personal and commercial use in music production. It is a licence, not a transfer of ownership. All intellectual property remains with nikki.vst.
The Software requires macOS and a VST3- or AU-compatible digital audio workstation. Specifications are published on the product page. You are responsible for confirming compatibility before purchase. Incompatibility with an unsupported system does not give rise to a refund unless the Software fails to perform as described — see the Refund page.
If you are a consumer under the Australian Consumer Law, the Software carries statutory guarantees: that it is of acceptable quality, fit for any purpose represented, and matches its description. These guarantees cannot be excluded, restricted, or modified by contract.
If the Software has a major failure, you are entitled to choose a refund or replacement. If it has a minor failure, we will repair, replace, or refund at our election. See the Refund page for how to make a claim.
All audio content, DSP code, visual assets, presets, and documentation are and remain the intellectual property of nikki.vst. All rights not expressly granted are reserved.
To the maximum extent permitted by law, our liability for any loss or damage arising from use of the Software is limited to the amount you paid for it. We are not liable for indirect, incidental, or consequential damages.
Nothing here limits or excludes any liability under the Australian Consumer Law, including the statutory guarantees in sections 51–53, or under any other legislation that cannot be excluded by law.
Updates may be released at our discretion. Where an update is material to the Software performing as described, we will make reasonable efforts to deliver it. Support: contact@nikkivst.com. Response within three business days.
These terms may be updated. The version in effect at the time of your purchase governs that transaction. Continued use after any update constitutes acceptance.
These terms are governed by the laws of Victoria, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of Victoria. Nothing here affects your rights under applicable EU consumer protection law if you are located in the European Union.
